“Express” transfer of property without bureaucracy

An important step to reduce the bureaucracy involved in the process of transferring property, by condensing the number of attached documents to two, was announced during the Notaries webinar entitled: “The implementation of the provisions of forest legislation and the impact of the ratification of the forest maps in the notarial practice”.  

 

According to the announcement made by the Hellenic Federation of Property Owners (POMIDA), given that the application of the Independent Authority of Public Revenue “My Property” for the payment of Transfer Property Taxes (FMA) is now functional, the competent Ministries of Finance and Environment and Energy, in collaboration with the Ministry of Electronic Governance, decided to deal with the chronic problem created by the numerous and disperse attached documents which are required by the laws in effect, by integrating them in two documents which will be issued within three business days at most. However, the accuracy of the information must also be guaranteed in a solemn declaration made by the property sellers via the relevant application of www.gov.gr. More specifically:

 

The Ministry of Finance will issue the “UNIFIED CLEARANCE CERTIFICATE” which will cover and replace: tax, insurance and municipal clearance, the declaration that no property taxes (ENFIA) are owed, the declaration that no inheritance/ parental grant taxes are owed and the calculation and payment of the Property Transfer Tax (FMA).

 

The Ministry of the Environment and Energy will issue the “UNIFIED LEGITIMACY CERTIFICATE” which will cover and replace: urban-planning legitimacy (attestation for the subsumption of illegal constructions), the Energy Performance Certificate, the attestation that the property was declared to the Cadastral Authority/ Land Registry and the attestation that the property does not include forest lands (Forest Maps).

 

With the issuance of these two CLEARANCE & LEGITIMACY certificates and the relevant electronic solemn declarations of the sellers, the “Electronic Property Transfer File” will be completed and this file will then be reviewed by the notary who will call the contracting parties for the signature of the transfer contract.

 

As for the Transfer Tax, only one declaration per buyer will be filed regardless of the number of sellers and transferred properties. The new process will be put into effect on April 31, while on September 1, it will be expanded to include transactions, distributions, donations and parental grants, the reiteration or correction of a contract as well as the sale of property in execution of preliminary agreements and all declarations for the amendment of information.

 

Once this process is in full effect, the waiting time for the drafting of contracts will be reduced from two to three months currently to 6-8 business days, a momentous event for the extroversion of the property market and all that it encompasses.
