Today, by unanimous decision of the special general assembly of the members of the Notaries’ Association of the Courts of Appeal of Athens, Piraeus, the Aegean and the Dodecanese, it was decided that as of today until January 26, 2020, they will abstain from their duties.

More specifically, in a hotel in central Athens, a special general assembly was held today (8/1) which was attended by more than 400 notaries.

The notaries attending the meeting voted almost unanimously (except for 12 members who supported the view of the President of the Association, Georgios Rouskas, against the strike), in favor of the strike which commences on this day and will continue until January 26 when the regular general assemble will be held, and if there is no quorum, on February 2, 2020.

The notaries are abstaining from auctions, from any property transfer deeds and any deed which requires the payment of the contributions to the EFKA and tax declarations. Wills and other simple notarial deeds are excluded.

More specifically, the notaries are reacting to the recent regulations which transfer the responsibility for the electronic submission of the tax declarations for property transfers, under the threat of heavy fines. They accept – as they mentioned during the meeting – the responsibility for the electronic submission of the declarations for the payment of property transfer taxes but they object to the fact that they would have to confirm the amount of the tax instead of the tax authority (DOY).

Also, they requested improvements to the recent legislative regulations, to ensure the transactions, the citizens and the State’s interests.

Με σημερινή σχεδόν ομόφωνη απόφαση της έκτακτης γενικής συνέλευσης των μελών του Συμβολαιογραφικού Συλλόγου Εφετείων Αθηνών, Πειραιώς, Αιγαίου και Δωδεκανήσου, αποφασίστηκε από σήμερα έως την 26 Ιανουαρίου 2020, η αποχή από τα καθήκοντα τους.

Ειδικότερα, σε κεντρικό ξενοδοχείο των Αθηνών πραγματοποιήθηκε σήμερα (8/1) η έκτακτη γενική συνέλευση, στην οποία συμμετείχαν άνω των 400 συμβολαιογράφων.

Οι παριστάμενοι συμβολαιογράφοι ψήφησαν σχεδόν ομόφωνα (εκτός από 12 μέλη που τάχθηκαν με την άποψη του προέδρου του συλλόγου, Γεώργιου Ρούσκα, για μη αποχή), υπέρ της αποχής έως την ημέρα της τακτικής γενικής συνέλευσης που θα πραγματοποιηθεί την 26η Ιανουαρίου, και σε περίπτωση μη απαρτίας, την 2α Φεβρουαρίου 2020.

Οι συμβολαιογράφοι απέχουν από τους πλειστηριασμούς, από κάθε πράξη μεταβίβασης ακινήτου, και κάθε πράξη που απαιτεί καταβολή ΕΦΚΑ και δηλώσεις φόρου. Εξαιρούνται διαθήκες και άλλες απλές συμβολαιογραφικές πράξεις.

Αναλυτικότερα, οι συμβολαιογράφοι αντιδρούν για τις πρόσφατες ρυθμίσεις που τους μεταβιβάζουν την αρμοδιότητα της ηλεκτρονικής υποβολής των φορολογικών δηλώσεων για τις μεταβιβάσεις ακινήτων, απειλώντας τους με βαριά πρόστιμα. Αποδέχονται - όπως τονίστηκε και στη συνέλευσή τους - την αρμοδιότητα της υποβολής ηλεκτρονικά, των δηλώσεων για τον καταλογισμό των φόρων στις μεταβιβάσεις, αλλά αντιδρούν στο να βεβαιώνουν εκείνοι και όχι η φορολογική αρχή (ΔΟΥ) το ύψος του φόρου.

Τέλος, έχουν ζητήσει βελτιώσεις στις πρόσφατες νομοθετικές ρυθμίσεις, ώστε το πλαίσιο να διασφαλίζει τις συναλλαγές, τους πολίτες και το συμφέρον του Δημοσίου.
